These Terms and Conditions (“Terms”) govern your access to and use of the website and services offered by Appalachian Artillery & Hardwoods (“Appalachian Artillery & Hardwoods,” “we,” “our,” or “us”) through our site (the “Site”). By visiting or using the Site, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, do not use the Site.

1. Eligibility

The Site and the products sold through it are intended only for individuals 21 years of age or older. By using the Site, you represent that you are at least 21 and are not prohibited by any federal, state, or local law from possessing firearms or ammunition.

2. Federal Age Requirements

Ammunition

• 18 years or older – to purchase shotguns, rifles, and their ammunition.
• 21 years or older – to purchase handguns, all other firearms, and their ammunition.

Firearms

• 21 years or older – to purchase handguns or shotguns with pistol grips.
• 18 years or older – to purchase rifles or standard shotguns (without pistol grips).

3. Account Registration

Creating an account may be required for certain Site features. You agree to provide accurate, current information, maintain the confidentiality of your credentials, and promptly update any changes. You are responsible for all activity under your account.

4. Compliance With Laws

You are solely responsible for knowing and obeying all federal, state, and local laws governing the purchase, possession, and use of firearms, ammunition, and accessories. Orders that violate any applicable law will be refused or canceled.

5. Orders and Payment

Prices and product descriptions may change without notice. Your order constitutes an offer to purchase; acceptance occurs when we email a confirmation. We may refuse or limit quantities at our discretion. You authorize us (through our payment processor) to charge the full amount due, including taxes, shipping, and any applicable excise taxes, to your chosen payment method.

6. Firearm Purchase & Shipping Requirements

Federal law prohibits shipment of firearms directly to individuals across state lines; firearms must ship to your chosen Federal Firearms License (FFL) dealer.

1. Place your order online and list your dealer in the “Ship To” field if known.
2. Confirm the dealer’s transfer fees and policies before purchasing.
3. Ensure the dealer emails us a signed copy of their FFL.
4. We will email tracking information when the firearm ships.
5. All firearm sales are final once you transfer the firearm from your FFL dealer.

7. Shipping & Delivery

• Orders ship via a trackable ground service; a signature from someone 21 or older is required for firearms and ammunition.
• Title and risk of loss pass to you when the carrier accepts the shipment.
  We ship only where permitted by law; you are responsible for any local permits, fees, or paperwork.

8. Returns & Cancellations

All sales are final. We do not accept returns or exchanges. You may request cancellation of an unshipped order by contacting us at [email protected]; orders already in the shipping queue cannot be canceled.

9. Intellectual Property

All text, graphics, logos, images, and software on the Site are owned by Appalachian Artillery & Hardwoods or its licensors and are protected by intellectual-property laws. You may view, print, or download content for personal, non-commercial use only. Any other use requires our prior written consent.

10. User Content

If you submit reviews, comments, or other material (“User Content”), you grant Appalachian Artillery & Hardwoods a perpetual, royalty-free, worldwide license to use, display, reproduce, and distribute that content. You may not post unlawful, defamatory, obscene, or infringing material. We may remove or edit User Content at any time.

11. Prohibited Conduct

You agree not to:

• Violate any law related to firearms or ammunition.
• Misrepresent your age, identity, or eligibility.
  Interfere with Site security or functionality.
• Use bots, scrapers, or other automated means without permission.
  Upload viruses or malicious code.
• Infringe intellectual-property or privacy rights.
  Harass, threaten, or harm others.

12. Safety Warnings

• Use only ammunition suited to your firearm’s chambering.
• Inspect barrels for obstructions; wear eye and ear protection.
  Store firearms and ammunition securely and separately, away from children.
• Never handle firearms under the influence of drugs or alcohol.
  Shooting or handling ammunition may expose you to lead; use proper ventilation, wear gloves, and wash hands after exposure.

13. Disclaimer of Warranties

The Site, products, and services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation.

14. Limitation of Liability

To the fullest extent permitted by law, Appalachian Artillery & Hardwoods and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use. Our total liability to you for any claim will not exceed the amount you paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Appalachian Artillery & Hardwoods, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of your breach of these Terms or misuse of the Site or products.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or applicable law.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of OH, without regard to its conflict-of-laws rules. Any dispute shall be resolved exclusively in the state or federal courts located in OH, and you consent to their jurisdiction.

18. Changes to These Terms

We may update these Terms at any time. Revised Terms will appear on this page with a new “Effective Date.” Continued use of the Site after changes take effect constitutes acceptance.

19. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.

20. Entire Agreement

These Terms, together with our Privacy Policy and any product-specific policies, constitute the entire agreement between you and Appalachian Artillery & Hardwoods regarding the Site and supersede all prior or contemporaneous understandings.
